TERMS AND CONDITIONS OF THE CONTEST DRAW FOR A TRIP TO MAYAKOBA DURING LIV GOLF MAYAKOBA

GENERAL INFORMATION:
Name of the contest: “Draw for a trip to Mayakoba during LIV Golf Mayakoba” (hereinafter, the “Contest”)
Coverage: Contest valid from February 2 to February 4, 2024, during the sports event “LIV GOLF MAYAKOBA,” held at El Camaleón Golf Course in Mayakoba – Quintana Roo, Mexico (hereinafter, the “Event”).
Organizer and responsible for the contest: RLH Properties, S.A.B. de C.V. (hereinafter, the “Organizer”).
Organizer’s Address: Paseo de la Reforma 412, Floor 21, Colonia Juárez, Cuauhtémoc Borough, Postal Code 06600, Mexico City.
Validity: from February 2, 2024, to April 5, 2024 (hereinafter, the “Validity”).
Draw Date: April 5, 2024.

ELIGIBILITY REQUIREMENTS TO PARTICIPATE IN THE CONTEST:
Any individual willing to participate and meeting all the following requirements established in these terms and conditions (hereinafter the “Participant” or the “Participants” interchangeably) can participate in the Contest:
1. Be of legal age (18 years old).
2. Have attended the Event on at least one date during its celebration.
3. Have an official photo ID that verifies the date of birth and identity (Voter ID, Passport, etc.), to be shown in case of winning.
4. The Participant must have read and accepted the terms and conditions, as well as the privacy notice of the Contest.
5. Participants must have their own email address to participate in the mechanics.
Those who cannot participate include family members up to the third degree of an employee or employees of the Organizer, subsidiaries and/or agencies, as well as any companies belonging to the same group of economic interests to which the Organizer belongs, and companies linked to the execution of the Contest, including service providers of the Organizer.
MECHANICS OF THE CONTEST:
To participate in the Contest, the Participant must follow the mechanics below:
1. Register in the Organizer’s system using the electronic devices provided by the Organizer during the Event.
2. There will be one winner selected through a random system chosen by the Organizer, and the result will be announced through a post on Mayakoba’s official Instagram (https://www.instagram.com/mayakoba).
3. Subsequently, the winning Participant will be contacted by the relevant department of the Organizer via email to request the sharing of their personal information, such as full name, email, and preferred travel dates.
4. The winning Participant has until March 15 to confirm the information requested by the Organizer.
PRIZE:
To be eligible for the prize, Participants must comply with the mechanics of the Contest and the eligibility requirements set out in these terms and conditions.
The prize (“Prize”) consists of the following:
- A 4-night stay at any of the hotels within the Mayakoba complex (Andaz Mayakoba, Fairmont Mayakoba, Banyan Tree Mayakoba, or Rosewood Mayakoba) for the winner and one companion, to be enjoyed from March 1, 2024, to December 15, 2024, excluding blackout dates (indicated below) and subject to availability of the chosen hotel.
- Transportation from Cancun Airport to Mayakoba Complex and back to Cancun Airport.
- $2,000.00 USD (two thousand US dollars 00/100 legal currency of the United States of America) in Resort Credit, redeemable for food and beverages, amenities or activities within Mayakoba Experiences, and spa treatments. Consumptions exceeding this amount will be the responsibility of the winning Participant.
- One free round of golf for 2 (two) people, including golf clubs. Any additional expenses related to this activity will be borne by the winning Participant.
The Prize does not include:
- Flights or expenses related to the transfer of the winning Participant and their companion, except for the transportation provided by the Organizer from Cancun Airport to Mayakoba Complex and back to Cancun Airport.
- Once the Resort Credit is exceeded, the difference will be the responsibility of the winning Participant.
- Tips.
- Personal expenses.
- Additional nights.
- Damages caused by the winning Participant and/or their companion.
- Any additional expenses not specified in this section 4.
SELECTION OF THE WINNING PARTICIPANT:

The winning Participant of the Contest will be announced on April 5, 2024, through a story from Mayakoba’s official Instagram account (https://www.instagram.com/mayakoba), which will be featured for one week after its publication.

The winning Participant will be selected by a random draw through a system chosen by the Organizer, which will be broadcast live on Mayakoba’s official Instagram account.

The Organizer will verify the following information of the winning Participant:
1. That they meet the eligibility requirements listed in point 2 above.
2. That they have followed the steps of the mechanics listed in point 3 above, as well as having given their consent for the use of their personal data and accepted these terms and conditions.
3. Verify the age of the winning Participant through a valid photo ID (Voter ID, Passport, etc.).
AWARDING AND DELIVERY OF PRIZE:

The winning Participant will be notified via the provided email. They must respond confirming their full name, phone number, and share an official photo ID.

Once the information is received and validated by the Organizer, they will ask the winning Participant for the hotel, preferred dates (excluding blackout dates and subject to hotel availability), and companion’s information to coordinate their stay. The winning Participant must inform the Organizer at least 30 calendar days in advance of their chosen date. Approximately 10 calendar days after receiving the information, the Organizer will contact the winning Participant to confirm or, if necessary, modify their reservation.
GENERAL CONSIDERATIONS, CLARIFICATIONS, AND RESTRICTIONS:
1. Any violation of the terms and conditions, any falsity in registration, or erroneous and/or malicious conduct by Participants will result in their immediate disqualification, at the complete discretion of the Organizer.
2. By participating in the Contest and receiving any benefits, participants agree to hold the Organizer, its subsidiaries and/or affiliates, shareholders, officers, directors, board members, and dependents harmless from any complaint, claim, report, or any other equivalent related to any damage, loss, expense, expenditure, or contingency arising from the acceptance, use, or enjoyment of the incentive that may arise or be claimed by a third party.
3. The Organizer reserves the right to establish and pronounce on situations or circumstances not expressly provided for in these terms and conditions that are beyond the control of the Contest organizer, clarifying that any modification will be adjusted to current legislation and duly communicated to participants.
4. The Organizer does not endorse any specific brand of technological inputs and any other participation requirement in the Contest.
5. The Organizer reserves the right to disqualify from the Contest any person who jeopardizes its integrity and proper development, such as so-called “hackers” (a term used to refer to individuals with great knowledge in computing and telecommunications who are employed for personal and/or profit purposes, which may be malicious and illegal) or so-called “promotion hunters” (defined as any participant who acts alone or together with economic, material, or informational resources unfairly compared to other participants to obtain the benefit of the Contest, regardless of whether the mechanisms used are unorthodox, ethical, moral, or even illegal).
6. Participation in this Contest implies the acceptance of all its terms and conditions, which are final, with the Organizer being the only one authorized to interpret them.
7. Any relationship arising from the Contest between any Participant and the Organizer will be governed and agreed upon with total adherence to the laws and competent courts of Mexico City, with the Participant waiving any other law to which they may be entitled.
8. Family members up to the third degree of an employee or employees of the Organizer, subsidiaries and/or agencies, as well as any companies belonging to the same group of economic interests to which the Organizer belongs, and companies linked to the execution of the Contest, cannot participate.
9. Blackout dates: February 19, May 27, March 28 to 31, October 28 to November 1, and December 17 to January 2.
10. The Prize is personal, non-transferable, not redeemable for cash, or any other experience provided by the Organizer.
11. The refusal of the winning Participant to provide or share information or documents, or the lack of response within the established deadlines, will imply their waiver of the Prize.
12. The hotel may require the winning Participant to pay a “security deposit,” which will be refunded at the end of their stay or up to 30 days later, depending on the financial institution backing their credit card.
13. The hotel may require a credit card during check-in, which, if necessary, may be used to charge the expenses incurred by the winning Participant or their companion, not included in the Prize.
14. The Organizer may disqualify any participant under the following circumstances:
  - Failure to meet the participation requirements stated in these terms and conditions.
  - Employees, consultants, suppliers, or service providers, or their family members up to the third degree, of the Organizer or companies related to the operation or implementation of the Contest, cannot participate.
  - Any information or document provided by the Participant that is false.
  - Any indication that it is an inauthentic participation request or if there is any minimal evidence that a participant or a related third party is attempting to harm or take undue advantage, they will be disqualified from participating and removed from the Contest. The Participant, in these circumstances, will be subject to the competent authorities for the corresponding civil and/or criminal proceedings. This determination will be at the discretion of the Organizer.
  - The use or development of any type of computer system or program that allows participation to be automated or modifies the results obtained. Whether directly or through a third party, allowing a third party to access and/or use their profile account on their behalf or on their own through an automated process.
  - Download, copy, attack, or attempt to alter or manipulate part or all of the content of the applicable social network.
  - Perform or execute any other act or activity that could be considered fraudulent or inappropriate under applicable law.
  - In case of identifying any irregularity in the winner’s participation, including family ties with any of the Contest’s service providers or providers, the winner must return the Prize to the Organizer.
COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS:

By participating in the Contest, the Participant expressly and irrevocably authorizes the Organizer, along with its affiliates and subsidiaries, to disseminate in the media they determine, considering it appropriate without territorial limits, to fix, reproduce, and disseminate their full name, photographs and/or use of image or portrait, videos and/or voice, and in general, all data that may be required for the dissemination of the Contest, expressly and irrevocably waiving, from the acceptance of these terms and conditions, any kind of economic compensation, remuneration, royalty, or any other remuneration for such use, as long as the purposes are advertising and informative in relation to the prevailing law, for which, by accepting these terms and conditions, the necessary authorizations are issued by the Participants.
ORGANIZER’S LIMITS OF LIABILITY:

The Organizer will disclaim any responsibility and dispose of the Prize as it deems best in its interests in the following cases: (i) In case the winner does not claim the Prize (or does not receive it due to reasons attributable to themselves), or claims it after the date indicated in section number 3 of these terms and conditions; (ii) Participants provide erroneous data for the delivery of the respective incentive; (iii) in case the Participant violates any point contained in these terms and conditions.

The Organizer may suspend the Contest or the delivery of the incentive at any time without any liability, if such suspension is in compliance with any mandate from an authority with powers to that effect, as well as if there are circumstances of force majeure or events that prevent the execution of the Contest.

The responsibility of the Organizer concludes at the moment of delivering the Prize to the winner.
The Organizer assumes no responsibility for the participation in this Contest by minors, as it is a promotion only for adults.

The Organizer reserves the right to take legal action against any of the Participants who have committed an unlawful act in relation to the Contest, using any legal resources or actions that are legally applicable.
PRIVACY NOTICE:

In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, and its Regulations, we make available the Privacy Notice – RLH Properties.
APPLICABLE LEGISLATION:

These terms and conditions and the relationship that is generated between any Participant and the Organizer will be governed and agreed upon with total adherence to the applicable laws in Mexico and the jurisdiction of the competent courts of Mexico City, with the Participant and the Organizer waiving any other jurisdiction that may be applicable based on their domicile or for any other reason.
